When atv is cold and stationary for couple of hours, oil dipstick shows 1cm(1/4inch) over limit but when I turn it on for a minute or two its right where its supposed to be on a max line. So my question is do I have to drain some oil from the engine? Please someone help.

No, you are fine. Mostly you do not want the crank throw to impact the oil surface causing heat, foaming and resistance. As long at it is at the Max line it won't.
